Terms of Service

Welcome to Simulos, a platform provided by Simulos AI Inc (“Simulos,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of our website at simulos.ai and any related services we provide (collectively, the “Service”).

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Overview of Service

Simulos provides tools for companies to create simulated job tasks that both internal employees and external participants can complete. Simulations are evaluated and scored primarily by Simulos’ AI grading systems with human oversight, and results are shared with both the company and internal participants.

2. Account Registration

To use most features of the Service, users must create an account. You may register directly via our website or be added by a company user on your behalf. You are responsible for maintaining the security of your account.

3. Product Emails and Notifications

By using Simulos, you consent to receive transactional emails related to your use of the Service. These include but are not limited to simulation invitations, approval requests, and account-related updates. We do not send marketing or promotional emails without your explicit consent. You can manage your email preferences at any time or contact us with any concerns.

4. User-Submitted Content

  • You acknowledge that the content will be used solely for grading and evaluation purposes.

  • Simulos does not claim ownership of your content. We use it solely for grading, product improvement, and training AI tools in anonymized form unless otherwise agreed.

  • Companies that administer simulations may retain or review your content. Simulos is not responsible for how companies use submitted content.

5. Subscriptions, Credits, and Fees

Paid access to the Service is provided through subscription plans billed via Stripe (“Subscription”). By starting a Subscription, you authorize Simulos to charge your selected payment method for all fees, taxes, and any applicable overages as described below.

  • Plans & Prices. The Pro plan is available on (i) a Monthly basis at $100 per month which includes 50 credits per month, or (ii) an Annual basis at $1,000 per year which includes 500 credits upfront.

  • Credits. Credits are required to publish simulations and/or add participants (each simulation session consumes credits as described in the Service). Credits have no cash value, are non-transferable, and cannot be redeemed for a refund.

  • Rollover. Unused credits roll over subject to plan caps applied at refill or renewal: up to 100 credits per month on the Monthly plan and up to 1,000 credits per year on the Annual plan. Credits do not expire while your account remains active and in good standing.

  • Refills. Monthly plan credits are added each month; Annual plan credits are granted upfront at purchase/renewal. The Service may show an estimated next refill date/time.

  • Auto-Renew (opt-in). Subscriptions do not auto-renew by default. You may enable auto-renew in your account settings. If enabled, your plan will renew and be charged at the end of each billing period unless you turn auto-renew off before the renewal date. If auto-renew is not enabled (or is turned off), your paid plan will end at the close of the current billing period and your account will revert to the Free tier.

  • Overages & Top-Ups. If you run out of credits, you may (where enabled) purchase additional credits or upgrade your plan. We may restrict access to certain actions until sufficient credits are available.

  • Free Credits. New company accounts may receive promotional credits. Promotional credits are subject to any additional terms presented and may be modified or revoked at any time.

  • Taxes. Fees are exclusive of applicable taxes, which will be charged where required by law.

  • Refunds. Except where required by law, all fees are non-refundable. Annual prepayments are not refundable after purchase, including for unused credits or partial periods. Unless expressly stated, plan changes are not prorated.

  • Payment Failures. If a charge fails, we may suspend or limit your access until payment is made. You remain responsible for amounts due, and you agree to keep your payment method current.

  • Authorized Purchasers. Only admins or users granted purchasing permissions may initiate purchases or change plans on your company account.

  • Price Changes. We may change prices or plan features prospectively. We will notify you in advance, and changes take effect on the next billing cycle unless you cancel before renewal.

6. Cancellation

Subscriptions do not auto-renew by default. You may cancel at any time in the Service. Cancellation (or not enabling auto-renew) takes effect at the end of your current billing period; you will retain access through that date. Upon downgrade to the Free tier, remaining credits stay in your balance and remain usable subject to these Terms (including rollover caps).

7. Acceptable Use

  • Do not use the Service for any unlawful, harmful, or deceptive activity.

  • Do not misrepresent your identity or affiliation.

  • Do not interfere with the integrity or security of the Service.

We may suspend or terminate your access if you violate these terms.

8. Intellectual Property

Simulos owns all rights, title, and interest in and to the platform, including its design, code, and branding. You may not copy, distribute, or create derivative works without written permission.

9. Analytics and Attribution

We use analytics tools like PostHog, Google Analytics, and tracking parameters (e.g. UTM) to understand how users interact with Simulos and improve onboarding, product performance, and attribution. By using our Service, you consent to these analytics practices as described in our Privacy Policy.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time and for any reason, including but not limited to violations of these Terms.

This includes suspected abuse of our free trial program, such as creating multiple accounts to repeatedly access free simulation sessions. Simulos may investigate such behavior and take appropriate action, including limiting features, suspending accounts, or banning access entirely.

11. Disclaimer of Warranties

Simulos is provided “as is” without warranties of any kind. We do not guarantee accuracy, reliability, or fitness for a particular purpose.

12. Limitation of Liability

To the fullest extent permitted by law, Simulos shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

13. Hiring Decisions and Use of Results

Simulos provides simulated assessments and supporting analytics as decision-support tools only. All employment, promotion, or hiring decisions made using the Service remain the sole responsibility of the company administering the simulation. Simulos does not guarantee candidate outcomes, job performance, compliance with hiring laws, or the suitability of any participant, and Simulos will not be liable for any employment or hiring-related decisions, disputes, or consequences arising from the use of the Service.

By completing a simulation, participants acknowledge that the company administering the simulation—not Simulos—is responsible for any hiring or employment decisions. Participants agree not to hold the company liable for outcomes based solely on simulation results or guidance provided by Simulos.
